Weston man sentenced to prison for raping disabled woman

A Weston man has been sentenced to prison for rape.

Daniel Stump, 43, was transported from jail Tuesday to the courtroom of Wood County Common Pleas Judge Matt Reger.

Wood County Chief Assistant Prosecuting Attorney Pamela Gross said the plea agreement was for Stump to plead guilty to one count of rape, be sentenced to eight years in prison, and register as a Tier III sex offender.

Three additional rape charges were dismissed.

Gross said on Sept. 12, 2022, the Wood County Sheriff’s Office was contacted about a sexual assault that had occurred in Weston.

The victim, who was 26 years old at the time, lived in a group home and had the understanding of a 6 to 9-year-old, she said.

Another friend gave Stump her number and he called the group home and asked the victim if she wanted to go for a ride. He drove them back to his home in Weston and had sex with her against her will, Gross said.

Later that day, Stump returned the victim to the group home.

She told them what happened, was taken to the hospital for a sexual assault examination, and the DNA obtained was from the defendant, Gross said.

Reger asked Stump if that is what he did.

Stump shook his head but after a lengthy discussion with his defense attorney, he responded yes.

Defense attorney Steve Spitler asked the court to accept the joint sentencing recommendation.

Reger imposed a prison sentence of eight years, which could stretch to 12 years as the offense falls within Reagan Tokes Act regulations.

Reger said that the assumption is Stump will be released after eight years but the Ohio Department of Rehabilitation and Correction may challenge that presumption based on the defendant’s conduct.

Stump will be held no longer than 14 years, Reger said.

Stump had been placed under five years of community control supervision on Feb. 9, 2018, after pleading guilty to attempted felonious assault and failure to stop after an accident. He was indicted Feb. 1, 2023, just days shy of the termination of his sentence.

Reger said he had reserved 36 months in prison at the time of the 2018 sentencing.

He sentenced Stump to 36 months for this offense, which time to be served concurrent to the rape charge. Credit will be given for time served.

As a Tier III sex offender, Stump will be required to register every 90 days for life once he is released from prison.
