Former Wood County man indicted – again – on sexually oriented allegations

A former Wood County man indicted last year for a dozen sexually oriented offenses has been indicted again on similar charges.

Devin A. Beardsley, 40, formerly of Cygnet and currently of Ashtabula, was indicted July 10 for two counts of sexual imposition, both third-degree misdemeanors; two counts on unlawful sexual conduct with a minor, both third-degree felonies; 17 counts of pandering obscenity involving a minor or impaired person, 15 which were second-degree felonies and two which were fourth-degree felonies; and one count possessing criminal tools, a fifth-degree felony.

From April 1-30, 2021, and again from Aug. 1-31, 2022, he allegedly had sexual contact with someone other than a spouse that was offensive or reckless.

From Sept. 1-30, 2022, he allegedly engaged in sexual conduct with another person who was between the ages of 13 and 16 years old.

From May 1 to Aug. 4, 2023, he allegedly created, reproduced or published obscene material that had a minor as one of its participants or portrayed observers 15 times.

Twice on Aug. 4, he allegedly purchased or possessed obscene material that had a minor as one of its participants.

He allegedly had in his possession a 256-gigabyte external hard drive.

Beardsley was indicted in December for sexual imposition, a third-degree misdemeanor; two counts gross sexual imposition, both fourth-degree felonies; four counts unlawful sexual conduct with a minor, all fourth-degree felonies; and five counts pandering obscenity involving a minor or impaired person, all second-degree felonies.

The gross sexual imposition charges reference occurrences between Aug. 1-Aug. 31, 2022, and again between Sept. 1-Sept. 30, 2022, when he allegedly had sexual contact by purposefully compelling another to submit by force or threat of force.

The four unlawful sexual conduct charges reference occurrences from Nov. 1, 2022-Nov. 30, 2022, March 1, 2023-March 31, 2023, April 17-April 20, 2023, and May 15-May 20, 2023, when he allegedly engaged in sexual conduct with another while knowing that person was under the age of 16.

Five times on Aug. 4, he allegedly created, reproduced or published obscene material that had a minor as one of its participants or observers.

For the misdemeanor offense, from April 1-April 30, 2021, he allegedly had sexual contact with another knowing the contact was offensive to the other person.

On July 8, Beardsley appeared in the courtroom of Wood County Common Pleas Judge Molly Mack for a pretrial hearing on the 2023 charges.

It was reported at that hearing that all plea offers had been rejected and rescinded.

A three-day jury trial was confirmed to start Sept. 27 with a final pretrial set for Sept. 9.
